The document describes calibrators for a toxicology assay, which are standard laboratory reagents and do not involve AI/ML technology.
No
This device is a calibrator used to establish reference points for measuring substances in human specimens, not to treat a condition or disease.
No
Explanation: The device is a calibrator, used to establish reference points for assays, not to diagnose a condition itself.
No
The device description clearly states it is a "clinical toxicology calibrator" with a "matrix is urine" and specific levels of Benzodiazepines, indicating a physical substance used for calibration, not software.
Based on the provided text, the device described, "Abuscreen ONLINE BENZ 200 Calibrators," is an IVD (In Vitro Diagnostic).
Here's why:
- Intended Use/Indications for Use: The text explicitly states it is a "clinical toxicology calibrator" and a "device intended for medical purposes for use in a test system to establish points of reference that are used in the determination of values in the measurement of substances in human specimens." This aligns perfectly with the definition of an IVD, which is used to examine specimens taken from the human body to provide information for diagnosis, monitoring, or treatment.
- Device Description: The description reiterates its purpose as a calibrator for measuring substances (Benzodiazepines) in human specimens (urine).
- Predicate Device: The mention of a predicate device (K951595 Abuscreen ONLINE Calibration Pack) further supports its classification as a medical device, and specifically one used in a laboratory setting for testing.
The lack of information about image processing, AI/ML, anatomical site, patient age, user, or performance studies is typical for a calibrator, which is a component used within a larger IVD test system, rather than a standalone diagnostic device that directly analyzes patient data or images.

§ 862.3200 Clinical toxicology calibrator.
(a)
Identification. A clinical toxicology calibrator is a device intended for medical purposes for use in a test system to establish points of reference that are used in the determination of values in the measurement of substances in human specimens. A clinical toxicology calibrator can be a mixture of drugs or a specific material for a particular drug (e.g., ethanol, lidocaine, etc.). (See also § 862.2 in this part.)(b)
Classification. Class II (special controls). The device is exempt from the premarket notification procedures in subpart E of part 807 of this chapter subject to the limitations in § 862.9.

Dear Ms. Feijoo:
We have reviewed your Section 510(k) notification of intent to market the device referenced above and we have determined the device is substantially equivalent (for the indications for use stated in the enclosure) to legally marketed predicate devices marketed in interstate commerce prior to May 28, 1976, the enactment date of the Medical Device Amendments, or to devices that have been reclassified in accordance with the provisions of the Federal Food, Drug, and Cosmetic Act (Act). You may, therefore, market the device, subject to the general controls provisions of the Act. The general controls provisions of the Act include requirements for annual registration, listing of devices, good manufacturing practice, labeling, and prohibitions against misbranding and adulteration.
If your device is classified (see above) into either class II (Special Controls) or class III (Premarket Approval), it may be subject to such additional controls. Existing major regulations affecting your device can be found in the Code of Federal Requlations, Title 21, Parts 800 to 895. A substantially equivalent determination assumes compliance with the Current Good Manufacturing Practice requirements, as set forth in the Quality System Regulation (QS) for Medical Devices: General regulation (21 CFR Part 820) and that, through periodic QS inspections, the Food and Drug Administration (FDA) will verify such assumptions. Failure to comply with the GMP regulation may result in regulatory action. In addition, FDA may publish further announcements concerning your device in the Federal Register. Please note: this response to your premarket notification submission does not affect any obligation you might have under sections 531 through 542 of the Act for devices under the Electronic Product Radiation Control provisions, or other Federal laws or regulations.
